That can't be right. The dereliction of duty was on the lube boy. If the lube boy wasn't a licensed driver, he shouldn't have had the keys, period. If that isn't the law, we have just another breakdown in the system. If the policy of the shop is what they say, then it should have been read to the owner when he submitted the jeep, not just a signed contract. If the owner is deemed responsible, this will greatly impact all service activity.

A good example is a car falls off a lift and someone is killed, how can the car's owner be responsible for a unbalanced weight or misplaced pad? people hire professionals to handle car repairs for a reason. Now if I drop the car off the jack, that is all on me. (literally and figuratively.)
 
The owner can't be held liable for the dealership's incompetence in hiring someone who shouldn't have been driving. That falls under the liability of the dealership and not the owner of the jeep.
 
Loss of life is always a sad thing, but to actually sue the owner of the vehicle who had left it in the "CARE" of the dealer for proper service cannot, anyway, anyhow, be the car owner's liability over mishandling of the vehicle when being serviced! The dealer should also be required to pay for any damage to the Jeep! Sorry, this is on the dealer! The attorney who took on this case should lose their law license....one more thing wrong with our country these days...."I'll just cover my ass by sueing the owner!" "It's not our fault!"....Sickening! Am I missing something?
 
Another example why I just want to stay the fuck away from people. Unreal!

This is one of the reasons we live rural. The abundance of idiots is growing exponentially with no apparent slowdown, hence why we are moving even further out.

We just wish to be left alone and it seems people just want to be involved in every part of our lives, so we'll just go even further out and fence the entire yard to keep them all out.
